Terms of Service

The terms of this agreement (hereinafter referred to as the "Terms of Service") apply to the relationship between you and us regarding your use of our games, applications, stores, websites and related services (hereinafter referred to as the "Services").

4. User Content

We are not responsible for the conduct of any user who submits any User Content, and we assume no responsibility for monitoring the Service for inappropriate content or conduct. We do not and cannot pre-screen or monitor all User Content. Your use of the Service is at your own risk. By using the Services, you may be exposed to User Content that is offensive, indecent, or otherwise inconsistent with your expectations. You assume all risks associated with the use of any User Content in connection with the Services.

We reserve the right to review, monitor, prohibit, edit, delete, disable access to, or otherwise make unavailable any User Content in our sole discretion, without notice, for any reason or no reason. If at any time we choose to monitor the Services, we assume no responsibility for User Content and no obligation to modify or remove any inappropriate User Content.

5. License Restrictions

You agree not to do any of the following with respect to the Services:

Copy, reproduce, distribute, display, mirror, frame or use them (or any of our other materials, intellectual property or proprietary information) in any manner not expressly authorized in these Terms or permitted by applicable law;

Sell, rent, lease, license, distribute or otherwise transfer the Services, Games or any Content, including but not limited to Virtual Goods or Game Currency, including participating in or operating a so-called "secondary market" for Virtual Goods, Game Currency or Content;

Attempt to reverse engineer, derive source code, modify, adapt, translate, data mine, decompile or disassemble or create derivative works from the Services or any Content, except as otherwise required by applicable local law;

Remove, disable, circumvent or modify any technological measure we implement to protect them or any of our related intellectual property rights;

Interfere or attempt to interfere with the access of any user, host or network, including but not limited to sending a virus, overloading, flooding, spamming or mail bombing the Services or any of its users;

Encourage or allow anyone else to do any of the foregoing.

6. Disclaimer

The Application is provided on an "as is" and as available basis, and we (and its suppliers) expressly disclaim all warranties and conditions of any kind, whether express or implied, including warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. We (and its suppliers) make no warranty that any Application: (A) will meet your requirements; (B) will be available on an uninterrupted, timely, secure, or error-free basis; or (C) will be accurate, reliable, complete, legal, or safe.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

7. Modifications

We reserve the right, at our sole discretion, to modify, terminate or discontinue our Service (including any part thereof) or modify these Terms at any time, globally or on an individual basis, without notice. If we modify these Terms, we will post the modified Terms. By continuing to access or use our Service after we post modifications to these Terms, you agree to be bound by the modified Terms. If you do not accept the modified Terms, your only recourse is to stop using our Service.

8. Force Majeure

We shall not be liable for any delay or failure to perform its obligations due to factors beyond its reasonable control. Such factors include, but are not limited to, unforeseen circumstances or causes beyond our control, such as natural disasters, war, terrorism, riots, embargoes, actions by civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.

9. Severability

If any provision of this Agreement is held to be invalid or unenforceable for any reason, the other provisions of this Agreement will be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

10. No Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be void. Notwithstanding the headings of this section, we may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will be binding upon and inure to the benefit of the parties, their successors and permitted assigns.

11. Changes to Terms

We reserve the right to modify, add or remove these Terms (or parts thereof) to comply with changes in legal requirements, or to reflect changes in best practices or to handle additional features we release. If we make any material changes, we will notify you within a reasonable time by prominently posting a notice on our website or within the game.
